A survey of 5,000 UK employers revealed that while 82% of them feel vulnerable and at risk from being sued by their employees for causing workplace stress, discrimination, or for bullying, only a third were aware of the steps they could take to limit their liability. While stress at work cases are becoming less common, due to mixed decisions in the courts, the Court of Appeal has advised that employers who offer a confidential counselling and advice helpline are unlikely to be sued for causing workplace stress.
Putting employees under unreasonable stress or allowing them to be put under stress or bullied can lead to awards of damages. In a recent case, a Rover employee, who had been subject to bullying and abuse by fellow workmates, was awarded £12,500.
