Product Liability
Most product liability claims fall into a limited number of categories which include:-
- consumer goods
- food products
- bio-medical devices
- pharmaceutical products
Previously, to claim compensation one had to prove that it was the responsibility of the manufacturer and that they were "at fault". Current legislation removes the need to prove that they were negligent.
Product liability law now allows anyone injured, to make a claim whether or not faulty goods were sold to them. Additionally, foodstuffs are now also covered by the legislation. The major legislation covering product liability claims can be found in the following Acts of Parliament :-
- In England and Wales- the Consumer Protection Act 1987 (Modification) Order 2000 (Statutory Instrument 2000 No. 2771)
- In Scotland - the Consumer Protection Act 1987 (Modification) (Scotland) Order 2001 (Statutory Instrument 2001 No. 265)
- In Northern Ireland - the Product Liability (Amendment) Act (Northern Ireland) 2001
